Terms of Service

1. Agreement
These terms are an agreement between you and Zentient AI, LLC ("we", "us") for your use of Hypnocube. By creating an account or using Hypnocube, you accept them and our Privacy Policy.
Hypnocube is for practitioners using it for their practice. You must be at least 18 and based in the United States. If you sign up for a business, you confirm you can accept these terms for it.
2. Your account
Keep your sign-in details secret and tell us straight away if you think someone else has used your account. You are responsible for what happens in your account. We recommend turning on two-factor authentication.
3. Trial, plans and credits
- Free trial: 30 days with 150 credits. No card is needed, and the trial does not turn into a paid plan by itself.
- Hypnocube Pro: $59 a month, plus tax where it applies, including 500 credits each month. It renews every month until you cancel.
- Credits pay for AI features, such as writing script sections and mixing recordings. Current costs are on our pricing page. Credits are charged only when the action succeeds. Unused credits carry over while your trial or plan is active, can't be used after it ends, and have no cash value.
- Top-up packs are available while you have an active Pro plan.
- Cancelling: use Manage billing in the app. Your plan ends at the end of the period you have paid for, and you won't be charged again.
- Refunds: payments are not refundable, except where the law requires it. If a payment is refunded, the credits it added are removed.
- Price changes apply from your next renewal. We'll email you at least 30 days before they do.
4. When a trial or plan ends
We don't delete your data when a trial or plan ends. For 90 days your account is read-only. After that, you can still open your profile and billing, export your data, or delete your account until you choose a plan.
5. Payments from your clients
Clients pay you through your own Stripe account, which you connect in Settings. You are the seller. Payments go to your Stripe account, and we never hold your clients' money. Stripe's terms apply to your Stripe account. Your prices, deposits, cancellation and late-fee rules, refunds and receipts are between you and your clients, and you must tell clients about them before they book.
6. Your clients and their records
You are responsible for the client records you keep in Hypnocube. That includes:
- having the right to collect each client's information and getting the consents the law requires,
- following the laws and professional rules for your practice, including privacy and health-record laws,
- what you send to clients through Hypnocube, including emails, forms and recordings,
- answering your clients' requests to see, correct or delete their records.
We store and process client records only to provide Hypnocube to you, as described in ourPrivacy Policy. We do not currently sign HIPAA Business Associate Agreements.
7. Your professional judgment
Hypnocube is software, not a health care provider, and doesn't give clinical advice. AI-written scripts and generated audio can be wrong or unsuitable for a client. Review everything before you use it, and use your own professional judgment about every client and session.
8. Voice cloning
Clone only your own voice, recorded live by you, and use it only for your clients' recordings. We delete a voice we find isn't yours and may close the account that made it.
9. Acceptable use
Do not use Hypnocube to:
- break the law or anyone's rights, or impersonate anyone,
- send spam, or email people who are not your clients or did not ask to hear from you,
- upload malware, probe or overload our systems, or get around limits or security,
- copy, resell or reverse engineer Hypnocube, or use it to build a competing product.
10. Connected services
If you connect Stripe, Google, Microsoft, Apple or Zoom, their own terms apply to those accounts. We are not responsible for those services. You can disconnect them in Settings.
11. Your content and ours
You own what you put into Hypnocube, including your client records, scripts and recordings. You give us permission to store, process and display it only to run Hypnocube for you. We own Hypnocube itself, including its software, design, templates and soundscapes. You may use them only within Hypnocube and in the recordings you make for your clients.
12. Changes and availability
We work to keep Hypnocube available and may change or improve it. We will give you reasonable notice before removing a feature you pay for. Keep your own copy of important records. You can export everything in Settings at any time.
13. Ending this agreement
You can delete your account at any time in Settings. This cancels your plan and erases your data, as described in our Privacy Policy. We may suspend or close an account that breaks these terms or puts others at risk. Where we can, we will warn you first and give you time to export your data.
14. Disclaimer
Hypnocube is provided "as is" and "as available". As far as the law allows, we make no promises that it will be uninterrupted, error-free, or fit for a particular purpose.
15. Limit of liability
As far as the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for all claims is limited to what you paid us in the 12 months before the claim.
16. Indemnity
You will cover our costs from claims brought by your clients or others that arise from your practice, your client records, or your breach of these terms.
17. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
18. Changes to these terms
We will update the date at the top when these terms change, and email you at least 30 days before a material change takes effect. If you keep using Hypnocube after that, you accept the new terms.
